RENTAL AGREEMENT and TERMS and CONDITIONS
for Villa Bahce and Villa Selim

We hope you enjoy the house and appreciate the care we have taken to make the villa comfortable. Please show the same level of respect and care for the contents of the house as you would your own.

Please first read the agreement, fill-out the information below, print it, sign it and fax or e-mail to us.

1. VILLA RENTAL AGREEMENT:

This is a self-catering villa rental agreement between the owner, Mr. Levent Ileri, and the renter(s), . The terms and conditions for this rental property agreement are outlined below.  Please read them carefully, and print, place your initials on each page, fill-out all highlighted sections in yellow, mainly, Sections 1, 1a, 1b, 1c, 1d, 1e, 1f, 2a, and sign the agreement table below indicating your acceptance of the terms for villa rental, and scan and e-mail this page to Mr. Levent Ileri at contact@turkishseasidevilla.com or mail it to Mr. Ileri's home address at:

As soon as the 35% of the rental cost (booking requirement) is received, the calendar for Villa Selim or Villa Bahce will be blocked for your stay; however, the booking is not final until the signed contract is received by us and we confirmed the receipt of the signed agreement to you via e-mail.

a. Villa Rented: The renter agrees to rent VILLA . This villa is a self catering home which means that you are being provided with accommodation that has facilities to allow you to cook and cater for yourselves while staying at our villa.  Please note it is your responsibility to purchase food and household essentials like food, cleaning items, shampoo, etc.

b. Dates of Rental Period:
This rental period shall commence on , 2010 at or after 4:00pm.

Currency: The owner and the rental agrees that the currency used in this rental agreement is in throughout this rental agreement.

d. Rental Cost: The rental cost agreed upon between the owner and renter is . This does NOT include electricity, gas, water, and the one time cleaning, but includes applicable Turkish taxes (VAT).

e. Extra Costs: There are 2 extra costs.
e.1: We provide weekly cleaning to all renters; however, there is a one time cleaning fee of
Euros.  For renters staying more than 2 weeks or more, we provide free of charge weekly cleaning, change of bed sheets and towels.
e.2: A daily utility charge of
Euros per day to cover electricity, gas, and water for the entire duration of your stay. 

f. Refundable Breakage Deposit:  The breakage deposit is This deposit is refundable and will be returned to you once the keys are returned and the villa is checked for substantial damages and losses. This process takes approximately 2 weeks. You must notify the property manager of any loss or damage caused by you, your family or your friends.  Should the security deposit prove inadequate to fully cover damage costs, the owner reserves the right to invoice you for the prompt payment of the outstanding amount. If rental fees are paid via credit card, the breakage deposit is waived with a small fee on the rental systems' web site.

g. Number of Guests: The number of guests that will be staying at the villa is agreed to be .  Only the number of persons agreed may use the property. The number of people must not exceed 8 for Villa Selim, and 7 for Villa Bahce.

2. PAYMENT PROCESS:

The 35% non-refundable booking requirement cost is due within 2 weeks of booking, and the remaining 65% of the rental cost and the refundable breakage deposit of 200 GBP (or its equivalency as indicated in Section 1f above) are due by 12 weeks (84 days) prior to the arrival date. If the remaining balance is not received by the due date, the owner reserves the right to treat your booking as cancelled by you. If you book within two calendar months of arrival date, you will be required to pay the full cost of the property rental and the breakage deposit at the time of booking.

a. Booking Process and Payment Dates:  A non-refundable 35% of villa rental cost as booking requirement is due with this signed agreement to hold the rental property for the dates listed in Section 1b. The dates for below will be provided to you by the owner via e-mail.  The payment dates are set out below:
 

Total Rental Cost = Rental Cost (Section 1d) + Extra Costs (Section 1e)

35% of the total rental cost (booking requirement), which is , is due within 3 to 7 days, and

65% of the total rental cost AND the breakage deposit, which is
, is due 84 days (12 weeks) prior to the arrival date, by   , 2010.  

b. Late Check-Out Fees: For any delays in check-out, absent prior consent of Owner, the Owner shall charge a late departure fee of 75 GBP (or its equivalency in another currency). The owner is flexible and will do his best to accommodate your schedule for the time period you booked the villa.  Please confirm with him your flight schedule as soon as it is arranged.

c. Animals: Villa Selim & Villa Bahce are pet-friendly properties. However, prior arrangements must be made in advance, and there is a non-refundable charge of 50 GBP (or its equivalency in another currency) per week per pet required. All reasonable requests will be honored. If the property manager finds that you have undeclared pet(s), the pet fees will be deducted from the breakage deposit. If the breakage deposit does not cover the total pet fees, the extra fees will be billed to you separately.

d. Excessive Guests: If your party size exceeds the agreed number of people in your party at the time of booking, there is an additional 50 GBP (or its equivalency in another currency) charge per person per week.  Should the owner or the local representative (the key holder) find that the number of people staying at the property exceeds the number agreed upon in advance, you will be charged 100 GBP (or its equivalency in another currency) per person per week for persons over the agreed number of people in your party. Applicable charges will be deducted from the breakage deposit.

e. Payment Method: The payments must be paid by either wire transfer to our bank accounts (in the USA, Canada, UK, France, or Turkey, and we will provide you the account details depending on your country), credit card, debit card (ATM), or USA issued bank check.  You can also use www.paypal.com to send your payments to the ILERI@YAHOO.COM address. All transactions fees associated with wiring or sending money will be borne by the renter.

3. CANCELLATION POLICY:

If you (or any member of your party) wish to cancel all or any part of your booking, the owner must be notified of the decision IN WRITING. The cancellation will take effect from the day the written confirmation is received. The following cancellation schedule will apply:

  • If you cancel at any time, the 35% booking requirement is always forfeited. Moreover;
    • If you cancel between 8 and 12 weeks prior to your arrival date, 65% of the total booking will be forfeited in addition to the 35% booking requirement. And,
    • If you cancel within 8 weeks prior to your arrival date, there are no refunds. This means 100% of the total booking cost is forfeited.
  • If full rental cost is not paid in full and on time, the owner reserves the right to treat your booking as cancelled by you.
  • No shows, late arrivals, or early departures do NOT constitute a reason for refunding any portion of the total booking cost.

If cancellation should occur due to force majeure (natural disaster, fire, flood, earthquake, etc) in or around the Village of Gundogan directly affecting Villa Selim & Villa Bahce, all of the deposit and fees (all rental costs) will be returned to you.  The security / breakage deposit will be refunded 100% upon cancellation, if paid.  The owner also encourages you to explore travel insurance options from your home country to cover any of your expenses if you were to cancel your reservation.

4. REPLACEMENT, DAMAGE, AND EXCESSIVE CLEANING CHARGES:

The owner reserves the right to levy a charge for any replacement of household items and damage to the house. The property will be cleaned prior to checking into the villa. Please leave the villa in the same condition as you find it.  On durations of 2 weeks or more, the villa will be serviced at the expense of the villa owner approximately after every 7 nights, unless other arrangements are made.  Each service is inclusive of cleaning the villa and changing the bed linen and towels.  You are responsible for any undue and/or unreasonable cleaning of the villa immediately after your departure.  This charge will be deducted from the breakage deposit.

a. Air Conditioners: The cost of electricity is very expensive in Turkey compared to Europe and the USA.  Therefore, we kindly ask that you please turn off the air conditioners before you leave any room and especially before you leave the villa for extended periods of time.  Your rental fee covers reasonable usage of electricity on a weekly basis.  If the allocated amount of electricity usage exceeds what we deemed to be an appropriate amount on a weekly basis, we reserve the right to levy a further charge, which will be deducted from the breakage deposit.  If our air conditioners break and we need to call for repair, the work will be done as soon as possible. However, there are no refunds on rental cost due to equipment failure.

b. Villa Keys: A 25 GBP (or its equivalency in another currency) fee will be charged to you for failure to return any and all related keys and/or gate access cards (if applicable), and such charge shall be deducted from the security deposit. Keys should either be provided to the property manager, or be placed in the security key box as you vacate the property.  If keys are lost during your stay, you will be charged 25 GBP (or its equivalency in another currency) for replacement of keys, and this will be deducted from the breakage/security deposit.

c. Smoking: Smoking in our villas is strictly forbidden.  For those who wish to smoke, the dining terrace and the sun deck are the only acceptable places to smoke. Please use the ash trays provided. If it is determined that smoking took place inside the property, a cleaning charge will be deducted from the security deposit based on the damage caused as determined by the property manager.

d. Furniture, Cutlery, Crockery, and Linens: Furniture, cutlery, crockery, linen and other items are included in the property, and all persons should show consideration and care for all items within the property.  To prevent damage to the wood furniture, we kindly ask that coasters be used at all times.  Please clean the oven and other kitchen equipment prior to your departure.

e. Fireplace: Should you choose to use the wood burning fireplace at either villa, you will be responsible to clean out all ashes after use.  Please make certain to open the mechanism inside the unit to allow smoke to escape.   

f. Television (TV): Our televisions are pre-programmed to provide all satellite TV channels that our service providers. The stations and instructions are provided in English.  If you wish to change the default settings, please bring the settings back to what they were before.  Please do not delete channels.  The satellite technician charges us 20 GBP (or its equivalency in another currency) to fix the configurations at our receivers.  If it is determined that the settings were changed and we need to call a technician, this charge will be deducted from your security deposit. If our TVs break and we need to call for repair, the work will be done as soon as possible. However, there are no refunds on rental cost due to equipment failure.

g. BBQ: Should you choose to use the gas burning BBQ at either villa, you will be responsible to clean the unit.  Please leave the BBQ in the same condition as you find it.  If the BBQ does not function and we need to call for repair, the work will be done as soon as possible. However, there are no refunds on rental cost due to equipment failure.

h. Sun Beds: Please use the pool towels on the sun bed cushions if you apply suntan oil or spray.  This will help keep the sun beds clean for the next guest.  Please leave the sun beds in the same condition as you find them.

5. ITEMS BEYOND THE OWNER’s CONTROL:

a. Alterations in Your Travel Plans: All reasonable requests will be honored based on availability, as long as the booking is in the same year.  If the villa is not available for your alternate arrangements, the cancellation policy as listed in Section 3 will apply accordingly.

b. Personal Safety: The owner has to the best of his knowledge taken all reasonable steps to ensure that the villa offers safe and comfortable accommodation.  The owner urges you to take caution with child safety, balconies, surfaces such as tiled floors that may become slippery when wet, fire, stairs, swimming pools, etc. The owner provides no lifeguard for the swimming pool and therefore, guests take full responsibility for their own safety should they wish to use the pool.

c. Pool Periods: For 2010, the communal pool for Villa Bahce will be open from May 1 to October 31.  The communal pool for Villa Selim will be open from June 1 to September 30.  For regular cleaning and maintenance purposes, the pools may be closed for a few days. Since this is beyond the owner’s control, the owner cannot be held responsible, and therefore, this does not constitute a reason for refunding any portion of the total booking cost.

d. Responsibility for Personal Items: You must ensure that the property is securely locked when not occupied during the holiday let. Loss of any personal items from the villa is not the responsibility of the owner.

e. Liability: Neither the owner nor the key holder (property manager) will be liable for any accident, damage, loss, physical injury, force majeure, expense or inconvenience which the client or any other person may suffer or incur. Should you be concerned about health insurance coverage while on your vacation, the owner encourages you to explore travel insurance options from your home country.

6. GENERAL TERMS:

a. Telephone Service: Currently, telephone service is ONLY provided at Villa Selim.  There are no fees or charges for using this service.  Instructions for usage are provided in the Information Resource Package.  Please note that it is not uncommon to experience electric outages while in Turkey.  This may interrupt any electric operated machines and services, including the telephone service.  At this time, there is NO Telephone service at Villa Bahce. However, the owner is in the process of having telephone service established for Villa Bahce but cannot guarantee the timing of the establishment of this service.  Once established you will be informed if the phone is working prior to your arrival.

b. Behavior: The Villa Selim & Villa Bahce community is welcoming and inclusive of everyone. However, please use discretion regarding the level of noise and disruption.  People choose this community for relaxation and the comfort of beautiful surroundings.  The pool hours are listed on the wall across from the pools.

c. Location of Our Villas: Both Villa Bahce and Villa Selim are located in small exclusive developments on the hills near the village of Gundogan on the Bodrum Peninsula overlooking the intersection of the Aegean & Mediterranean Seas.

d. Distances From the Villas:  The distances below are approximate as they were measured during normal traffic.

Villa Bahce to Villa Selim (or vice versa) = 1 min by driving (or 4 mins by walking)
Private Seaside Facilities = 4 mins by driving, or 10-15 mins by walking
Village of Gundogan = 10 mins by driving
Bodrum = 35 mins by driving
Bodrum International Airport (BJV) = 50 mins by driving
